PLL Legal secures a Victory at the Swiss Arbitration Centre (SAC)

Our firm secured a victory at the Swiss Arbitration Centre (SAC), the leading commercial dispute resolution institution in Switzerland.

We successfully defended the interests of a private client in a complex structured loan dispute. The case was centered on our client's property located in the South of France, a region often associated with intricate international real estate matters. The case was argued before the arbitral tribunal by Ignacio Guaia, of counsel and Dr. Pavel Kulikov, partner.

The claimant who was represented by another Legal 500 law firm of the year in Switzerland argued multiple violations of pre-contractual and contractual loan documentation, including failure to provide additional collateral upon request. As a result, the claimant argued that our client should bear all incurred transaction fees, legal costs, as well as the significant costs of arbitration.

The arbitral tribunal challenged with applying Swiss, French and the EU law in this matter has reaffirmed our position that there was no violation of contractual documentation by our client and therefore the claimant is not entitled to any of the fees and costs incurred, including all legal and interest fees claimed.
